SUVIR SEHGAL, J (ORAL) Petitioners have approached this Court under Article 226/227 of the Constitution of India inter alia, seeking issuance of a writ in the nature of mandamus directing the respondents to pay them the minimum of pay scale, revised from time to time, with permissible allowances, as is being paid to similarly placed regular employees, along with monetary benefits, in view of judgment of the Supreme Court in State of Punjab and others Versus Jagjit Singh and others (2017) 1 SCC 148.

CWP-16371-2018 The admitted case of the petitioners is that they were engaged on various Group - D posts on daily wage basis between the years 1987 to 1994. They were drawing a fixed salary of Rs.575/-. Their services were regularized on 01.02.1996 and 01.10.2003, respectively, as is apparent from their service particulars, appended with the writ petition as Annexure P-1. Once the petitioners have been regularized, they start drawing salary of a regular incumbent. Therefore, the claim of the petitioners is misconceived. In this view of the matter, as the petitioners are already drawing the regular pay scale, no direction can be issued to the respondents.
Petition is dismissed.
