A student who was admitted to a tractor mechanic course on 15.09.2014 was stopped from attending classes by the Principal without assigning any reason from 18.09.2014. After the writ petition is filed, the State is on record to state that the petitioner has been readmitted and he is attending classes. The State would also contend in the written statement that the admission must be taken as a fresh admission in December, 2014.

The grievance of the petitioner is that he will be seriously prejudiced by the lack of attendance caused by the conduct of the State which was not appropriate. I find the conduct of the respondent to be unacceptable and direct that the petitioner was deemed to have the requisite attendance, since the non-continuance in the course was not on account of any default on the part of the petitioner. CWP No.23325 of 2014 (O&M) -2hands on experience during the period from 18.09.2014 when he actually permitted to attend in December, the respondent shall give extra classes at no extra cost. The additional cost that has to be incurred shall be absorbed by the State itself.
