Versus

Special Secretary, Department of Housing Development, Chandigarh exercising the powers of revisional authority under the Punjab Regional and Town Planning and Development Act, 1995 and others

...Respondents

CORAM: HON'BLE MR. JUSTICE S.J. VAZIFDAR, CHIEF JUSTICE HON'BLE MR. JUSTICE HARINDER SINGH SIDHU Present:- Mr. Sarbjit Singh Khaira, Advocate, for the petitioner.

* * * * S.J. VAZIFDAR, C.J. (ORAL) The petitioner was allotted a flat in the LIG quota in May, 1988. 25% of the consideration was paid within time. Thereafter, not a single installment was paid. This was despite the fact that there were several demands for payment made by the respondents. Ultimately, the respondents cancelled the premises on 29.07.2003. Even thereafter, the petitioner did nothing. An appeal was filed only in the year 2007 i.e. after about four years. The appeal was dismissed on 03.07.2008. An application for revision was filed on 20.10.2016 i.e. after a further delay of eight years. The revision application was dismissed on 24.11.2016. 2.

In these circumstances, the authorities had no option, but to dismiss the matter. It is evident that the petitioner had no interest in continuing with the allotment and had abandoned the same.

3.

The petition is, therefore, dismissed.
