The petitioner by way of present writ petition under Articles 226/227 of the Constitution of India, has laid challenge to the order dated 06.09.2016 (Annexure P-1) passed by respondent No. 1 through its Officerrespondent No. 2 whereby the petitioner-Company was blacklisted/debarred from entering into any business for the next five years. 2.

On October 20, 2016, learned counsel for the petitioner inter alia submitted that the impugned order of blacklisting/debarring the petitioner was passed without affording an opportunity of hearing and by passing a non-speaking order and following order was passed on the said date:- "Learned senior counsel for the petitioner inter

Learned senior counsel for the respondents on instructions submitted that the impugned order Annexure P-1 blacklisting/debarring the petitioner may be set aside. However, liberty be granted to the respondents to pass a fresh speaking order in accordance with law and after affording an opportunity of hearing to the petitioner.

Learned counsel for the petitioner submits that the same is agreeable to the petitioner.

Accordingly, we dispose of the present writ petition by setting

-3aside the impugned order dated 06.09.2016 (Annexure P-1), with liberty to the respondents to pass a fresh speaking order in accordance with law and after affording an opportunity of hearing to the petitioner.
