Anil Kumar v. State Of Haryana And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CWP No. 18120 of 2017 Date of decision: 17.08.2017 Anil Kumar ....Petitioner(s)
Versus
State of Haryana and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Shalender Mohan, Advocate, for the petitioner.
G.S.SANDHAWALIA, J. (Oral) The petitioner seeks compliance of the transfer order dated 12.05.2017 (Annexure P-1) and for joining at Hisar in pursuance of the above said order. It is his case that he has been relieved from the Chandigarh Depot for Hisar on 06.08.2017 (Annexure P-2). If that is the case, it is open to the petitioner to approach the respondents for joining. A writ of mandamus as such would not lie without approaching the respondents for the necessary grievance at the first instance. Nothing has been placed on record that any such representation has been moved to the competent authority at Hisar to show that his joining is not being effected by respondent no. 3.
Accordingly, the present writ petition is dismissed as not maintainable at this stage with liberty to the petitioner to approach the respondents at the first instance.
