(ORAL) This is a petition that has been filed for grant of regular to the petitioner in FIR No.0013 dated 26.02.2020 under Sections 363, 366-A IPC (Sections 376 IPC and Section 4 of POCSO Act added later on) registered at Police Station Balachaur, District SBS Nagar, who is in custody since 29.02.2020.

Learned counsel for the petitioner herein would contend that the allegation as set out in the FIR are patently false and even otherwise, the matter has been compromised between the parties as would be evident from Annexure P-2 wherein the prosecutrix herself affirmed the factum of compromise along with her father i.e. the complainant. Appearance on behalf of complainant/respondents No.2 and 3 has been caused by the counsel Mr. Pannu, who also affirms the factum of compromise entered into between the petitioner and private respondents and PANKAJ KUMAR 2020.11.05 15:44 I attest to the accuracy and integrity of this document

CRM-M No.35512 of 2020 (O&M) -2submits that they would have no objection in case regular bail is allowed to the petitioner herein.

I have heard learned counsel for the parties and have perused the paper book.

Keeping in view the fact that a compromise has been arrived at between the petitioner and the private respondents herein, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
