(Oral) The grievance of the petitioner in the present writ petition is that at the time of appointment, a resolution was passed wherein the age of the petitioner was mentioned as 28 years whereas he was 21 years at that time as his date of birth is 05.04.1961 by considering which, he is going to be retired on 22.10.2016.

Learned counsel for the petitioner submits that the petitioner made a representation and his case was also sent by respondent No.2 to respondent No.3 but no action has been taken so far. It has specifically been mentioned in that letter that the date of birth of the petitioner be verified from the original certificate issued by the concerned department and action be taken as per rules but nothing has been done. Learned counsel also submits that the petitioner would be satisfied in case, directions are issued to the concerned officer to take action as the matter is still under Neetu Rani 2016.10.21 10:19 I attest to the accuracy and authenticity of this document Chandigarh

In view of the submissions made by learned counsel for the petitioner and also the fact that the matter is still under consideration before the concerned authorities, the present writ petition is disposed of with a direction to respondent No.3 to take action in accordance with law by considering the original certificate of date of birth issued by the competent authority as mentioned in Annexures P-4 and P-5 with the present writ petition.
