Petitioners have filed the instant petition under Article 226 of the Constitution of India read with Section 528 of BNSS of 2023 seeking issuance of writ in the nature of Mandamus for directing respondents No. 2 and 3 to protect the life and liberty of the petitioners from the hands of private respondent No.6, who is harassing the petitioners by calling them in the police station at the behest of the private respondents No.4 and 5 by causing them threat to implicate in false case and pressurizing them not to pursue their complaint against the private respondent. 1.1.

A further prayer has been made for directing respondents No.2 and 3 to take action on the application dated 21.05.2025 (Annexure P-1) of the petitioners, which is pending before respondent No.2. 2.

Learned counsel for the petitioners submits that the petitioners would be satisfied at this stage, if a direction is issued to respondent No.3- SHO, Police Station, Shimlapuri, District Ludhiana to consider/decide their application dated 21.05.2025 (Annexure P-1). 3.

At this stage, Mr. Nirmaljit Singh Diwana, Sr. DAG, Punjab appears on behalf of the respondent(s)-State of Punjab pursuant to the advance copy of the petition having been sent to the State of Punjab and submits that he has no objection to the said course of action and states that the claim/grievance of the petitioners as stated in their representation dated 21.05.2025 (Annexure P-1) shall be looked into by the respondent

authorities.

In view of above, without expressing any opinion on the merits of the case or the claim being made by the petitioners in the representation, respondent No.3- SHO, Police Station, Shimlapuri, District Ludhiana; is directed to consider and decide the representation dated 21.05.2025 (Annexure P-1), submitted by the petitioners, in accordance with law, after affording due opportunity of hearing to all concerned parties. 5.

It is made clear that this order shall also not be taken to protect the petitioners from legal action for violation of law, if any, committed by them.

The present petition stands disposed of accordingly. 7.
