*** Daya Chaudhary, J. (Oral) The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of writ in the nature of mandamus directing the respondents to grant step up benefits on completion of 14 years of service as per ACP Scheme as granted to all other eligible employees of State Government.
Learned counsel for the petitioner submits that the case of the petitioner was recommended by respondent No.3 to respondent No.2Director, Rural Development and Panchayats on 12.07.2016 but no decision has been taken so far. The petitioner has also served a legal notice (Annexure P-3) through her counsel on 02.09.2016 but no action has been taken so far. Learned counsel also submits that the petitioner would be satisfied in case, directions are issued by this Court to the respondents to decide the legal notice (Annexure P-3).

CWP No.21774 of 2016 writ petition is disposed of with a direction to respondent No.2 to consider the legal notice dated 02.09.2016 (Annexure P-3) and pass necessary order in accordance with law/policy/ACP Scheme within a period of two months from the date of receipt of certified copy of this order. In case, the petitioner is found to be entitled for the relief claimed in the legal notice, the same be granted to her within two months thereafter.
In case, the petitioner is still aggrieved in any manner, she is at liberty to avail the appropriate remedy.
