HARINDER SINGH SIDHU, J Prayer in the instant petition filed under Section 439 Cr.P.C is for grant of interim bail for 10 days to the petitioner in case FIR No.0226 dated 14.08.2020 under Section 8 of POCSO Act registered at P.S City Rupnagar, District Rupnagar on account of his own marriage. As per allegations in the FIR, the petitioner was working as a Security Guard in Sakhi One Stop Center, Rupnagar. Son of the complainant, who was also working in the said office, used to come to her office. The petitioner is alleged to have touched private parts of son of the complainant, while the complainant was attending urgent medical emergency case and her son was playing with the petitioner. It is the case of the petitioner that his marriage has been fixed to be solemnized on 31.10.2020. Learned counsel submits that no other case is registered against the petitioner and that the petitioner undertakes to surrender before the jail authorities immediately after his marriage ceremony.

The fact regarding marriage of the petitioner has not been disputed by the learned State counsel.

In these circumstances, the present petition is allowed and the petitioner is directed to be enlarged on interim bail for the period from 29.10.2020 to 07.11.2020 subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. On the expiry of the period aforesaid, the petitioner shall surrender to the trial Court/Duty Magistrate concerned.
