(ORAL) In the present writ petition, the claim of the petitioner is for considering the service rendered by him with the Haryana State Minor Irrigation Tubewell Corporation for the purpose of fixation of pay, grant of ACP and other pensionary benefits after he was absorbed in the Irrigation Department keeping in view the instructions issued by the Government of Haryana dated 26.06.2006.

Counsel appearing on behalf of the respondents-State points out that the same question of law came up for consideration before a Division Bench of this Court in LPA No.1105 of 2017 titled as 'The State of Haryana and others Vs. Nathu Singh, decided on 29.05.2018, wherein, the Division Bench after considering all the relevant facts held NARESH KUMAR 2019.08.29 13:18 I attest to the accuracy and integrity of this document Chandigarh

CWP-21800-2016 -2that no benefits of past service can be given to the employees, who were absorbed with the Government of Haryana in pursuance to the Notification dated 26.06.2006. The SLP filed against the said judgment has also been dismissed by the Hon'ble Supreme Court. Faced with this situation, counsel for the petitioner very fairly states that he does not want to press the present writ petition any further and the same may be disposed of as such. Keeping in view the above, present writ petition is disposed of as having not pressed.
