(ORAL) The petitioner has approached this Court under Articles 226/227 of the Constitution of India seeking direction especially in the nature of certiorari for quashing the condition contained in Annexure A of Contract Forms and condition of contracts and specially Condition No.19(ii) concerning to experience of having successfully completed similar works during last 5 years ending last day of month previous to the one in which tenders are invited (Annexure P-6) being illegal, unconstitutional, arbitrary, discriminatory, against the public interest and Public Policy and violative of Articles 14, 19(1)(g) and 304(b) of the Constitution of India. After arguing for sometime, learned counsel for the petitioner submitted that he may be permitted to withdraw the present writ petition with liberty to the petitioner to pursue the representation which has been filed before the authorities concerned.
