Both the cases involve similar issues and therefore, are being disposed of together by this common order, for the sake of convenience the facts are derived from CWP-2605-2013.

Prayer made in the present petition is for directing the respondents to grant pay scale of Rs.2100-3700/- with arrears and seniority as also promotion of Superintendent Home w.e.f. 06.04.1989 as also to quash the order dated 21.10.2010 vide which pay of the petitioner had reduced from Rs.23920/- to Rs.21320/-.

Learned counsel has made a reference to the letter dated 18.01.2023, Annexure P-21, addressed to the Director by the Principal Secretary, Department of Social Security and Women & Child Development to grant the consequential benefits to the petitioner alongwith recommendation for taking departmental action against the officers/employees, who took a wrong decision in the case, which has not been decided merely on the premise of pendency of the present case. CWP-2605-2013 (O&M) and other connected case instructions from the petitioner, who is present in Court, prays that a time bound direction may be given to the respondents to decide the claim by taking Annexure P-21 to its logical end.

Learned State counsel, on instructions, states that the matter would be considered in letter and spirit of letter dated 18.01.2023, Annexure P-21 and a decision taken thereon within a period of 3 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner.

The aforesaid satisfies the learned counsel for the petitioner. 6.
Disposed of accordingly, if the petitioner is found entitled to any benefit, shall be released within a further period of one month. Needless to say, if the orders are adverse to his interest, the same may be passed after granting opportunity of hearing to him and shall contain reasons, whereupon he shall be free to seek legal redress thereupon. 7.
