HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.331 dated 01.10.2017 under Section 22 of NDPS Act registered at P.S Sadar, Nakodar, District Jalandhar Rural.
As per allegations in the FIR, 250 grams intoxicant powder containing Alprazolam salt was recovered from the petitioner. Learned counsel for the petitioner submits that the recovery was not effected from the petitioner and that he is in custody since 01.10.2017 i.e almost three and half years.
Opposing the petition, learned State counsel submits that the alleged recovery falls under the commercial category and that out of 12, nine prosecution witnesses have already been examined. Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that on account of the current Covid-19 situation where the trial proceedings are being adjourned from time to time, in my opinion, no useful purpose will be MANOJ KUMAR 2021.04.08 09:46 I attest to the accuracy and integrity of this document
