Whether the judgment should be reported in the digest? DEEPAK SIBAL, J. ( Oral ) Through the present petition, the petitioner seeks appointment on compassionate grounds.

It is the admitted position that at the time of death of the father of the petitioner, the family of the deceased received terminal benefits amounted to Rs.12,38,628/-. It is further not disputed that at the time when the petitioner had made an application seeking compassionate appointment, he was himself a married man with children which dis-entitled him from consideration as per the instructions of the respondent-Food Corporation of India (hereinafter referred to as "the Corporation"). The record further reveals that compassionate appointment is sought for after over 12 years of the death of the father of the petitioner, who died on 5.3.2003. Further, as per the order under challenge, there is no vacant post against which the petitioner can be appointed.
