Present writ petition has been filed for setting aside the letters dated 08.10.2020 (Annexure P-7), 22.09.2020 (Annexure P-6) and letter dated 16.09.2020 (Annexure P-5) and further directing respondent No.4 to stop the second enquiry before the State Vigilance Bureau being wrong and illegal as it is on the same set of allegations upon which the earlier inquiry has been conducted. Further prayer has been made for directing the official respondents not to proceed with the second inquiry as the same is barred as per Section 53(5) of the Haryana Panchayati Raj Act, 1994 and for directing the respondents not to take any coercive action against the petitioner in pursuance to the impugned letters dated 08.10.2020 (Annexure P-5), 22.09.2020 (Annexure P-6) and 16.09.2020 (Annexure P-7).

 Learned counsel for the State submits that after filing of the present petition, fresh order has been passed by the respondents authorities dated 28.01.2021.

Learned counsel for the petitioner fairly submits that he may be allowed to withdraw the present petition with liberty to assail the fresh order dated 28.01.2021 passed by the respondents authorities in accordance with law.

Allowed to do so.
