It is the case of the petitioner that he was appointed as Process Server on 28.11.1991 by the Senior Sub Judge, Patiala on stop gap arrangement and thereafter he joined on the said post at Nabha. One vacancy had been caused on the promotion of one Sukhdev Singh, against which, he had been allowed to continue vide order dated 11.05.1992. On completion of 8 years of service, he was granted the next higher master scale w.e.f. 28.11.1999 and has not been granted the next ACP on completion of 9 and 14 years of service in the same cadre of the process server.

Counsel submits that a representation dated 01.05.2013 (Annexure P-6) has been served upon the respondent no. 2-The District Judge, Patiala for the abovesaid relief but no action has been taken on the SHIVANI GUPTA 2015.10.31 14:46 I attest to the accuracy and integrity of this document Chandigarh

Counsel further submits that he would be satisfied at this stage if a direction is issued to the said respondent to take a decision on the said representation within a time bound frame.

Accordingly, keeping in view the limited relief sought, this Court does not feel it necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the representation dated 01.05.2013 (Annexure P-6) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 28.10.2015 (G.S.
