AMIT RAWAL J. (Oral) Prayer in present writ petition is for grant of minimum regular pay scale meant for the post of Canal Patwari and arrears of salary from the initial date of his appointment alongwith market rate of interest and in this regard, similar situated employees have already been paid the salary but not the petitioner.
At earlier point of time, services of petitioner were terminated and approached the Labour Court wherein petitioner was found to be employee of department. However, he was paid salary through service provider. All the aforementioned grievance have already been raised in detail in the representation dated 24.04.2019, (Annexure P-3) . Mr. Tejpal Singh Dhull, learned counsel appearing on behalf of petitioner relies upon order dated 28.11.2018 (Annexure P-4) passed by this Court wherein similar relief has been granted to the similar situated employees. CWP No.19699 of 2019 {2} direction is issued to respondent No.2 to consider and decide representation dated 24.04.2019 (Annexure P-3) within some specified time. In view of statement made by learned counsel for the petitioner and without going into merits of case or commenting thereon, present writ petition is disposed of with a direction to respondent No.2 to decide the representation dated 24.04.2019 (Annexure P-3) within a period of two months from the date of receipt of certified copy of this order. In case, claim of the petitioner is accepted, consequential benefits, if any, be released to him, in accordance with law and if the claim of the petitioner is not to be accepted, then a well reasoned and speaking order be passed and conveyed to the petitioner forthwith. In case, representation is not decided within aforementioned specified time, there shall be costs of Rs.50,000/- to be paid by the concerned officer to the petitioner.
