Mr.Raj Kaushik, Advocate for respondents No.4 to 8. **** RAJ MOHAN SINGH, J.(Oral) The petitioners have preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus, directing the respondent No.3 to provide time table to the buses of the petitioners on the specified routes as mentioned in para No.3 of the writ petition.

Notice of motion was issued on 16.08.2022 on the premise that the petitioners are having regular route permit and they have not been considered while preparing new time table for operation of bus on route Nos. 924 and 1038 of 2003. During pendency of the present writ petition, an application under Order 1 Rule 10 read with Section 151 CPC has been filed by the proposed respondents No. 4 to 8 seeking to get themselves impleaded as party respondents. Learned counsel for the petitioners submits that the decision of this writ petition may take time. The petitioners have already represented before the respondent No.3 by means of representations dated 12.05.2022 and 27.05.2022 and legal notice dated 17.05.2022.

17791 of 2022 (O&M) -2At this stage, learned counsel for the petitioners submits that the petitioners would be satisfied in case their representations/ legal notice are directed to be considered and decided by the respondent No.3 in accordance with law in a time bound manner.

Learned State counsel and learned counsel for the proposed respondents have no objection in case the representations/ legal notice served by the petitioners upon the respondent No.3 are directed to be decided by the competent authority in a time bound manner. The only apprehension of the learned counsel for the proposed respondents is that while doing so, the competent authority may not hear the grievance of the proposed respondents.

Learned State counsel, on instructions from Ms.Malkiat Kaur, J.A. from RTA, Bathinda, submits that while passing an appropriate order on the representations/ legal notice of the petitioners, all the stake holders would be heard in accordance with law and thereafter, an appropriate order shall be passed.

In view of the aforesaid, this petition is disposed of, thereby directing the respondent No.3 to decide the representations/ legal notice of the petitioners in accordance with law within a period of one month from the date of receipt of certified copy of this order.
