(Oral) This is the first petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the petitioner in case bearing FIR No.239 dated 27.09.2024, under Section(s) 103(1), 238(a) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, registered at Police Station Rajaund, District Kaithal.

Succinctly, present FIR was registered on the complaint/ statement of Mandeep son of Balraj Singh @ Balwant Giri Maharaj, alleging therein that he received a call to the effect that his father- Balraj Singh @ Balwant Giri Maharaj (Monk) had been killed by someone at Nawanath Dera

-2by cutting his neck. It is stated that on receipt of the said information, he reached at the spot and found the dead body of his father lying below a shed on a wooden cot and there were marks of a sharp edged weapon on the right side of his neck and blood had clotted there. He submitted that he had satisfied himself that the previous night, some Shankar Giri's nephew Tinku and a Baba of Bharti Sect had been staying with his father and they all consumed liquor at the Dera and after consuming liquor, they both hit his father with an iron Tawa on the right side of his neck and killed him out of greed. The alleged Tawa was lying at the spot and had been recovered from there.

Learned counsel appearing on behalf of the petitioner contends that the role attributed to the petitioner would be at par with co-accused Sombir @ Sombharti to whom concession of regular bail has already been granted by this Court vide order dated 05.05.2026 passed in CRM-M-72612026. State counsel, on the other hand, does not dispute that case of the petitioner would be at par with the co-accused Sombir @ Sombharti to whom concession of regular bail has already been granted by this Court vide order dated 05.05.2026 passed in CRM-M-7261-2026.

Having heard the learned counsel for the parties and taking into consideration the period of custody undergone by the petitioner, the stage of the trial and the fact that the role of the petitioner is at par with co-accused Sombir @ Sombharti to whom concession of regular bail has already been granted by this Court vide order dated 05.05.2026 passed in CRM-M-72612026, extending the benefit of parity, I deem it appropriate to allow the present petition. Accordingly, the present petition is allowed. The petitioner is ordered

-3to be released on bail on his furnishing requisite bail bond/surety bond to the satisfaction of the Trial Court/Duty Magistrate, concerned. It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.

The observation made hereinabove shall not be construed as an expression on the merits of the case and the trial Court shall decide the case on the basis of available material.
