In the present writ petition, the petitioners claimed that though vide order dated 21.08.2015 (Annexure P-3), passed in CWP No.17433 of 2015, the petitioners have been held entitled for the modified ACP, but the said benefit was not being released to the petitioners so far.
Notice of motion was issued on 21.10.2016.
Upon notice, the respondents have filed the reply today in Court.
-2As per the reply, the benefits for which the petitioner had approached this Court have already been granted to them, vide letters dated 06.12.2017 and 11.12.2017 and copies of which have been appended as Annexures R-1 and R-2, respectively, with the present reply. Counsel for the petitioners states that though an order has been passed, but the actual benefits have not been released to the petitioners.
From the reply, it is clear that all the benefits have already been paid to the petitioners in respect of Annexures R-1 and R-2. The relevant paragraphs of the reply is as under: - "3.
That the respondent No.3 i.e. General, Manager, Haryana Roadways, Hisar has granted modified pay grade of Rs.3300-3600 and also fixed pay grade of Rs.14980+3600 to the petitioner namely Ramphal Singh, Electrician w.e.f. 04.03.2014. It is submitted that the respondent No.3 has re-fixed pension/gratuity of the petitioner as per his modified pay grade. The respondent No.3 has paid all the benefits to the petitioner as per letter of Accountant General, Haryana Chandigarh vide no.191985 dated 06.12.2017 (copy of the same is annexed as annexure R-1). 4.
That the respondent No.3 i.e. General Manager, Haryana Roadways, Hisar has granted modified pay grade of Rs.3300-3600 and also fixed pay grade 14980+3600 to the petitioner namely Randhir Singh, Electrician w.e.f. 04.03.2014. It is submitted that the respondent has re-fixed pension/gratuity to the petitioner as per his modified pay grade. The respondent No.3 has paid all the benefits to the petitioner as per letter of Accountant General, Haryana Chandigarh vide no.191998 dated 11.12.2017 (copy of the same is annexed as annexure R-2)."
In view of the above, the present writ is disposed of, having rendered infructuous.
-3However, it is made clear that in case orders/letters (Annexure R-1 and R-2) are yet to be implemented, as being claimed by the petitioners, the same shall be implemented within a period of two months from the date of receipt of certified copy of this order in all respects and a status report/confirmation report shall be sent to this Court about the compliance of the said report.
