By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus directing the respondents to extend the benefit of refixation of pay/pension of the petitioners w.e.f. 01.04.1979 as has been done in CWP No.16084-1997, titled as "Dharam Pal Singh v. State of Haryana" and CWP No.2757-1998, titled as "Diwan Chand and ors. v. State of Haryana, decided on 27.07.2000 by this Court in terms of CWP No.13300 of 1990 with all consequential benefits.

At the very outset of the arguments, learned counsel for the petitioners submits that though petitioners moved representation dated 09.12.2017 (P-8) to the respondents but till date neither any response has been received nor any conscious decision has been taken. CWP No.16662 OF 2018 --2-- petitioners feel satisfied in case a direction is issued to respondent(s) to consider and decide the representation (P-8) within a stipulated period. 3.

Accordingly, instant petition is disposed of with a direction to respondents to look into the grievances unfolded by the petitioner in representation (P-8) and to decide the same as per Rules and in the light of judgments passed in CWP No.16084-1997, titled as "Dharam Pal Singh v. State of Haryana" and CWP No.2757-1998, titled as "Diwan Chand and ors. v. State of Haryana", decided on 27.07.2000 by this Court in terms of CWP No.13300 of 1990, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioners still feel aggrieved by any order of the aforesaid authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
