Jaswant Singh,J(Oral) Petitioner claims to have been engaged as a Sweeper on daily wages at D.C. rates by Municipal Corporation,Ludhiana in 2007. It is claimed that he suffered spine pain in the lower back on 15.12.2015 and therefore, could not join his duties. He is stated to have remained under treatment from 15.12.2015 to 31.1.2016 and thereafter he was not permitted to join his duties. It is alleged that illegal money was also demanded for permitting him to join back. However, his engagement has been terminated without assigning any reason.

Prayer in the instant petition is for directing the respondents to consider the claim of the petitioner for rejoining/re-appointment or to decide his representation dated 2.2.2016(P-4).

After hearing the learned counsel and perusing the paper book in my considered opinion, no case for interference is made out. The petitioner has not placed on record any document indicating terms and conditions of his engagement. It is also not averred that he had been engaged through proper channel. In these circumstances, no writ of mandamus, as prayed for can be issued. Further, as regards the Rajinder Parshad Joshi 2017.02.07 18:11 I attest to the accuracy and integrity of this document

CWP 21970/2016 2 allegations of demand of illegal money the same also cannot be gone into on the basis of mere averments made in the petition in exercise of writ jurisdiction of this Court. That apart, the petitioner has approached this Court after a delay of more than one year from alleged disengagement from his duties.

Dismissed.
