" # $$%&% ' ( ) By way of this petition filed under Section 438 Cr.P.C.. petitioner has prayed for grant of anticipatory bail to him in case FIR No.50, dated 12.04.2023 registered under Sections 18, 25, 29 (added later on) of NDPS Act, at Police Station Chatiwind, District Amritsar.
It is contended by learned counsel for the petitioner that 8.5 kg of opium was allegedly recovered from the possession of Angrej Singh. Petitioner was not present at that time. Petitioner has been nominated in the disclosure statement of Angrej Singh as per which he had supplied 1.5 kg of opium to the petitioner. Contention of learned counsel for the petitioner is that the petitioner has been falsely implicated and has nothing to do either with Angrej Singh or with any offence.
Status report by way of affidavit of Shri Sucha Singh, Deputy Superintendent of Police (PBI & Anti Narcotics), Amritsar (Rural) has been filed on behalf of the respondent- State. As per status report, petitioner is not involved in any other case. Adjourned to 08.11.2023.
Having regard to the contents of the status report, in the meantime, in case of his arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/Investigating Officer. petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court.
