The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.150 dated 7.6.2019 at Police Station Kalayat, District Kaithal under Sections 323, 384, 388 and 120-B of Indian Penal Code.

While granting interim bail to the petitioner on 1.10.2019, the following order was passed:

"Prayer in the present petition is for grant of anticipatory bail to the petitioner in case F.I.R. No.150 dated 07.06.2019 under Sections 323, 384, 388, 120-B of the Indian Penal Code, registered at Police Station Kalayat, District Kaithal.

Learned counsel representing the petitioner contended that as per allegations, total amount of Rs.1.5 Lakh was extorted from the complainant and as per share of the petitioner, a sum of PANKAJ KAKKAR 2021.12.03 13:32 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-30732-2019 (O&M) Rs.30,000/- is to be deposited by the petitioner and the petitioner is ready to deposit the same, subject to his right to get the refund of the amount and he is ready to cooperate with the investigating agency.

Let the petitioner deposit a sum of Rs.30,000/- with the Registry of this Court and join the investigation and would come present as and when required for the purposes of investigation. In the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal bond and surety bond to the satisfaction of Arresting/ Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) Cr.P.C. Adjourned to 14.11.2019."

Learned State counsel, upon instructions from SI Gurdev Singh, has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and is not required for any custodial interrogation. It has also been informed that the petitioner is not involved in any other case.

In view of the aforestated position, wherein the petitioner is stated to have joined investigation and is not even stated to be required for any custodial interrogation and is not involved in any other case, the petition is accepted and the interim directions issued by this Court vide order dated 1.10.2019 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C.
