By virtue of instant civil writ petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of Mandamus directing the respondents to restore 100% pension w.e.f. 01.10.2011 and also to pay arrears of pension along with interest @ 12% per annum till date of payment.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner served legal notice dated 11.04.2018 (P-4) upon the respondents, which was forwarded to Regional Deputy Director, Department of Local Govt., Patiala and Executive Officer, Nagar Council, Barnala but till date no conscious decision has been taken. Instant petition is disposed of with a direction to respondent(s) particularly respondent No.4 to consider the case of petitioner unfolded in legal notice (Annexure P-4) and to take a conscious decision, within a period of three months from the date of receipt of certified copy of this order. 4.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
