The petitioner approached this Court challenging Memo dated 06.07.2018 from Block Development and Panchayat Officer, Hodal addressed to the petitioner (Annexure P-1) restraining him from raising further construction on the land in dispute.

In the present case an application filed by the Gram Panchayat under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 (for short,'1961 Act') was dismissed on 14.06.2018. Gram Panchayat preferred appeal against the aforesaid order, which is pending before the Collector, Palwal. Vide order dated 05.07.2018, operation of the impugned order passed by the Assistant Collector Ist Grade, Palwal, was stayed. CWP-16731-2018 -2was thereafter that the impugned communication was sent to the petitioner by the Block Development and Panchayat Officer directing him to remove the construction within three days.

After hearing learned counsel for the parties and considering the facts noticed above, in our view the present petition can be disposed of by directing the parties to maintain status quo regarding the land in question as the appeal filed by the Gram Panchayat against the order passed by the Assistant Collector dismissing the application under Section 7 of the 1961 Act, is still pending.
