Petitioner seeks quashing of order, Annexure P-9 whereby renewal of passport has been denied to him on account of criminal case pending against him. Limited prayer made before this court today is that in case petitioner is allowed to comeback from Italy to India, he shall face the trial and complete necessary formalities whereafter his case may be considered afresh. Mr. Mittal, at the outset submits that emergency certificate can be granted to the petitioner for return to India in case he applies to the Indian Consulate in Italy.
