(Oral) Prayer is for grant of anticipatory bail in case having FIR No.303 dated 16.12.2021 registered under Sections 148, 149, 323, 324, 325, 326, 506 & 201 IPC at Police Station Chhachhrauli, District Yamuna Nagar. Counsel for the petitioner submits that the petitioner was falsely implicated in the present case and there are allegations that the petitioner gave iron pipe blows on the arms of complainant-Khevan Dhiman and at the most the said injuries attract Section 325 IPC, which is a bailable offence. The counsel for the petitioner further submits that the petitioner has joined GAURAV SOROT 2022.11.10 10:28 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-35739-2022 investigation with the police by virtue of previous order dated 16.8.2022 passed by this Court.
State counsel on instructions from SI Baldev Raj has not disputed the fact that the petitioner has joined investigation with the police and further submits that grievous injury caused by the blunt weapon covered under Section 325 IPC is attributed to the petitioner. The State counsel further submits that recovery of said blunt weapon i.e. iron pipe has been effected and now petitioner is not required by the police for further investigation and the police has already presented the challan after the completion of investigation in this case.
In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 16.8.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
