HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.0423 dated 27.07.2020 under Section 20(b) (II) of NDPS Act registered at P.S Sadar Gurugram, District Gurugram.

As per allegations in the FIR, 420 grams of charas was recovered from the petitioner.

Vide order dated 04.11.2020, the petitioner was directed to be released on interim bail for the reason that the FSL report had not been received.

Learned counsel for the petitioner submits that the investigation is complete. The recovery is of non-commercial quantity. The petitioner is in custody since 27.07.2020.

Learned State counsel submits that the FSL report has since been received and the recovered contraband has been identified as charas. Investigation in this case is complete. Challan has been filed on 21.09.2020 and charges have also been framed with the trial having commenced. Case is fixed for prosecution evidence on 04.12.2021. CRM-M-35090 of 2020 #2# Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Vikram Singh is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
