The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order/letter dated 22.04.2026. She is further seeking direction to respondent to add/incorporate the surname/sub caste "GILL" in the birth certificate/record of her minor son namely Rannvijay Singh.

The petitioner solemnized marriage on 25.01.2011 as per Sikh rites and ceremonies. Out of the wedlock one male child was born at Chandigarh on 22.06.2012. Her marriage came to be dissolved by divorce decree dated 06.12.2015 passed by Learned Additional District Judge, SAS Nagar, Mohali. As per decree, custody of the minor child was given to her. Father of the child expired on 04.08.2018. As per petitioner neither child's father nor his family members were in the contact of child despite having visitation rights. The child has been brought up solely under her supervision and she is the only surviving parent as well as natural guardian. of registration of his birth, surname was not incorporated. He is known by two names i.e. Rannvijay Singh as well as Rannvijay Singh Gill. Now petitioner is intending to adopt his name as Rannvijay Singh Gill in order to avoid confusion in future. For the said purpose, she preferred an application dated 22.12.2025 before the respondent. Her claim was rejected vide letter dated 22.04.2026 on the ground that Higher Authorities has rejected her claim for want of additional/supporting documents for adding surname "GILL".

Learned counsel for respondents expressed his inability to controvert that no prejudice is being caused to anyone if surname 'GILL' is added in the name of petitioner's son.

The petitioner belongs to a family having surname 'GILL'. The petitioner is having passport wherein surname 'GILL' has been used along with the name of her mother. It discloses that petitioner belongs to 'GILL' family.

In the backdrop, respondents are hereby directed to consider petitioner's claim sympathetically and endeavour shall be made to carry out necessary amendments in the child's birth certificate. 6.
Let needful be done within two months from today. 7.
The petition stands disposed of.
