The same are taken on record.

CWP No. 18601 of 2017 The petitioner seeks the stay of the departmental proceedings initiated vide order dated 18.01.2017 during the pendency of the criminal proceedings.

Counsel very fairly has conceded that after the order of suspension dated 18.01.2017 w.e.f. 16.01.2017 though an inquiry officer has been appointed (Annexure P-1) but no further progress has been made since the petitioner is in judicial custody.

In such circumstances, this Court is of the opinion that at this stage no cause of action as such arises and it is always open to the petitioner to press the said relief as and when departmental proceedings are commenced.
