Challenge in the present regular second appeal is to the judgment and decree dated 01.09.2006 passed by learned District Judge, Bhiwani setting aside the judgment and decree dated 24.12.2002 passed by learned Additional Civil Judge (Sr. Division), whereby the suit for declaration was decreed in favour of the plaintiff-appellant.

Learned State counsel, in terms of the last order dated 16.12.2023, has received instructions that services of the appellant were regularized on 26.05.2012 in terms of the judgment of the lower Appellate Court wherein it had been directed to consider the case of the plaintiff for regularization when his turn comes. However, his services were terminated on 24.02.2016, therefore, the present appeal would not survive. Copy of the information received is placed on record as Mark-A.

In view of the aforesaid fact as also there is no representation on behalf of the appellant, the present appeal is dismissed for non-prosecution with liberty to the appellant to revive it.
