Learned counsel for the petitioner contends that the case of petitioner is covered under the policy for release of under-trials on bail on account of spread of pandemic COVID-19 as framed by the High Powered Committee under the Chairmanship of Executive Chairman, Punjab State Legal Services Authority. Learned counsel, in this regard, refers to the minutes dated 16.8.2021 of the High Powered Committed annexed as Annexure P-3. 2.

Learned counsel for the petitioner submits that he would be satisfied in case a direction is issued to the Trial Court concerned to consider his case in accordance with the said policy/minutes of the High Powered Committee as he fulfills all the criteria and falls within the parameters as framed by the PANKAJ KAKKAR 2021.09.27 19:10 I attest to the accuracy and integrity of this document

In view of the aforesaid submission, the petitioner is permitted to withdraw the instant petition with liberty to apply afresh to the Trial Court concerned. In case the petitioner applies afresh to the Trial Court concerned, the Trial Court shall consider the case of the petitioner in light of the directions issued by High Powered Committee under the Chairmanship of Executive Chairman, Punjab State Legal Services Authority regarding release of prisoners on account of spread of pandemic COVID-19 or under any other applicable notification pertaining to such release on account of the pandemic. It is hoped that such application if filed, shall be disposed of expeditiously in accordance with law.
