CHANDIGARH CWP No. 2224 of 2016 Date of decision: 04.02.2016 Nisha Rani ....Petitioner(s)
Versus
State of Punjab and another
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. P.S. Khurana, Advocate, for the petitioner.
G.S.SANDHAWALIA, J. (Oral) The petitioner seeks appointment to the post of Cutting and Tailoring Instructor (SC-ExSM) against the public notice/advertisement No. Admn.1/13 as published on 01.03.2013 (Annexure P-1). The consideration sought is on the basis of the merit list prepared (Annexure P-11) in which the petitioner figures at Sr. No. 7.
It is the case of the petitioner that there are two posts for the said category and apart from Kiran Bala, the persons above her have been found either not eligible or were absent at the time of counseling. It is accordingly submitted that the petitioner is entitled for appointment on the basis of the said advertisement and her merit. Counsel submits that apart from the representation (Annexure P-12), a legal notice dated 11.12.2015 (Annexure P-13) has been served upon the respondents for the necessary relief and decision on the same is pending and he would be satisfied if a time bound direction is issued to the respondents to decide the same.

CWP No. 2224 of 2016 Notice of motion.
Mr. R.S. Sidhu, AAG, Punjab accepts notice on behalf of the respondents. Copy of the writ petition has been supplied to him in Court. Keeping in view the limited relief sought, this Court is of the opinion that there is no need for the respondents to file reply. Accordingly, without commenting on the merits of the case, the writ petition is disposed of with a direction to respondent no. 2 to decide the legal notice dated 11.12.2015 (Annexure P-13) within a period of 2 months from the date of receipt of certified copy of the order. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner.
