PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.842, dated 31st of October, 2022 registered for the offences punishable under Sections 120-B, 323, 324, 506, 379-b, 326, 34 of the IPC, at Police Station Indri, District Karnal (Haryana).

Counsel for the petitioner submits that the injuries alleged to have been caused by the petitioner were all simple in nature. The investigation already stands concluded. Thus, the custody of the petitioner cannot be utilized as a punitive measure as there is presumption of innocence in favour of the petitioner till held guilty. She further submits that the petitioner is in custody since 1st of November, 2022. 3.

Counsel for the State does not dispute the aforesaid factual assertions made on the basis of record.

I have heard counsel for the parties and have gone through records of the case.

Without commenting on the merits of the case, keeping in view the incarceration already suffered by the petitioner and the fact that the investigation already stands concluded, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
