As observed in the previous order, none had made appearance on behalf of the respondent, despite service. Even, today none has made appearance on behalf of the respondent. As such, the respondent is proceeded against ex parte.

These are two transfer applications, filed at the instance of applicant-wife, for seeking transfer of the petition under Section 9 of the Hindu Marriage Act, bearing No.HMA-64-2024 and civil suit No.309 of 2024, both filed by the respondent-husband, titled 'Narinderpal Singh vs. Randhir Kaur'. Both the aforesaid cases are pending in the Courts at Khanna and she seeks transfer of the same to the Court of competent jurisdiction at Malerkotla.
At the very outset, it is submitted by learned counsel for the applicant that marriage between the parties had taken place on 23.09.2018 and one daughter, born from the said wedlock, is in the care and custody of the applicant. On account of matrimonial dispute, the parties are residing separate. The applicant herself has filed petition under Section 13 of the Hindu Marriage Act, which is pending in the Courts at Malerkotla and the same is at appearance stage. Besides the same, the applicant has also filed petition under Section 125 Cr.P.C., at the behest of her minor daughter and the same is also pending in the Courts at Malerkotla and the respondent is making appearance in the same.
Furthermore, it is submitted that the applicant is a government teacher, but however, on account of her medical ailment, which is a chronic disease, she remained on leave for long time. In this regard, learned counsel has placed reliance upon Annexure P-4, which is a 'Complicated Chronic Disease Certificate', issued under the signatures of Medical Superintendent, Rajindra Hospital, Patiala.
Perusal of the aforesaid certificate reveals that the applicant is
TA-768-2025 and connected case -3suffering from Systemic Vasculitis and this disease has also been declared as chronic disease vide Pb. Govt. Letter No.12/69/98-5HBV/21329-21333 dated 01.09.2000.
In the given circumstances, it is submitted that it is difficult for the applicant to commute a distance of 60 kms. to defend the litigation, initiated at the instance of the respondent.
Keeping in view the aforesaid mitigating circumstances, more particularly, the fact of applicant not having good health and suffering from chronic disease as well as taking care of the minor daughter, born from the said wedlock and above all, considering the fact of the respondent, having not come forward to resist the transfer application, as such, both the transfer applications are hereby allowed and the petition under Section 9 of the Hindu Marriage Act, bearing No.HMA-64-2024 and civil suit No.309 of 2024, titled 'Narinderpal Singh vs. Randhir Kaur', stands transferred from the Family Court, Khanna and trial Court Khanna, respectively, to the Court of competent jurisdiction at Malerkotla. The requisite record of the aforesaid case be sent by the concerned Courts at Khanna to the District and Sessions Judge, Sangrur.
Learned District and Sessions Judge, Sangrur shall assign both the said petitions to the concerned Courts of competent jurisdiction at Malerkotra. Even, the parties are directed to appear before the concerned Courts at Malerkotla, within a period of one month from today onwards.
