**** AJAY KUMAR MITTAL, J. (Oral) The prayer made in this writ petition filed under Articles 226/227 of the Constitution of India, inter alia for direction to the respondents to quash Tender Participation Notice dated 05.06.2017 of the amount of ` 4,19,00,000/- (Annexure P-7).

After arguing for sometime, learned counsel for the petitioner submitted that certain disputed questions of fact are required to be proved by leading evidence. Therefore, he may be allowed to withdraw the present writ petition with liberty to the petitioner either to approach the Civil Court or to avail an alternative remedy as may be available to him, in accordance with law.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to him, in accordance with law.
