Rajesh Bhardwaj, J. (ORAL) Present petition has been filed for setting aside the order dated 04.05.2026 passed by learned Chief Judicial Magistrate, Jalandhar in complaint case COMA No.141 of 2016 titled as Municipal Corporation, Jalandhar vs. Balram Gupta etc. whereby the application filed by the complainant/respondent under Section 311 Cr.P.C. for recalling the complainant witnesses for reexamination has been allowed. Learned counsel for the petitioner has submitted that after the allowing the application under Section 311 Cr.P.C., the respondent had availed three opportunities, but has not concluded the examination of its witnesses. Notice of motion.

Mr. Rehatbir Singh Mann, Advocate accepts notice on behalf of the respondent. He has submitted that the next date before the trial Court is 30.05.2026 and he would conclude the examination of the witnesses on that date.

After hearing learned counsel for the parties and perusing the record, this Court does not find any illegality in the impugned order. However, considering the submissions made by learned counsel for the respondent that the SHARMILA DEVI 2026.05.26 17:15 I attest to the accuracy and integrity of this document

CRM-M-30534-2026 -2examination of the complainant witnesses shall be concluded on the next date fixed before the trial Court i.e. 30.05.2026, the present petition is disposed of with a direction to the learned trial Court to ensure that the examination of the said witnesses is concluded on the aforesaid date itself. Needless to say that the petitioner shall be afforded adequate opportunity to cross-examine the witnesses in accordance with law.
