G.S.SANDHAWALIA, J. (Oral) The petitioners seek the relief of promotion as Senior Laboratory Attendants on the date their juniors had been promoted with all consequential benefits.

It is the case of the petitioners that they are working as regular Class-IV employees since 1987, 1991, 1992 and 1987 respectively and there is no complaint or inquiry pending against them and they are eligible for promotion as Senior Laboratory Attendants on the date their junior employees had been promoted. It has been further pleaded that the cases of Class-IV employees due for promotion had been asked for by respondent no. 3 and recommendation had also been made of petitioner no. 3 in the handicap quota and in the Scheduled Caste quota by the concerned principal.

Counsel for the petitioners submits that a legal notice dated 12.08.2015 (Annexure P-9) has also been served on behalf of petitioners no. 1 to 3 upon respondent no. 2 whereas on behalf of petitioner no. 4, SHIVANI GUPTA 2015.11.03 16:12 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 23277 of 2015 representation dated 15.06.2015 (Annexure P-10) has been served for the said relief but no action has been taken on the same. The details of juniors have been mentioned in the said Annexures. Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the said legal notice and representation within a time bound frame.

Keeping in view the limited relief sought and without commenting upon the merits of the case and the rights of the petitioners, this Court does not feel it necessary to call upon the respondents to file reply.

Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 12.08.2015 (Annexure P-9) and representation dated 15.06.2015 (Annexure P-10) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons.
