-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular to the petitioner in FIR No.222 dated 16.09.2020 under Sections 379-B, 120-B, 411-B IPC registered at Police Station Model Town, Hoshiarpur, who is in custody since 18.09.2020.
Learned counsel for the petitioner herein would contend that he has been falsely implicated in the said FIR on the basis of disclosure statements made by the main accused Harjinider Singh @ Kaka and Priti. It is also argued that he is not seen in the CCTV footage, while further submitting that the charge under Section 379-B against him has been substituted with Section 380 & 381 IPC and therefore, seeks concession of bail to the petitioner.
Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner on the ground that no case is made out for grant of regular bail to the petitioner. Keeping in view the fact that the petitioner is in custody since 18.09.2020 and the petitioner has been nominated in the FIR on the statement of co-accused coupled with the fact that the trial is likely to take some time to conclude owing to novel corona virus pandemic situation, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
