Ms. Anju Sharma Kaushik, DAG Punjab accepts notice on behalf of State/respondent nos.1 to 3 and raises no objection in case the present application is allowed.

In view of the agreed stand taken by both sides, present CM stands allowed and CWP No.18774=2017 is preponed and taken on board today itself.

    Present Civil Writ Petition has been filed under Article 226 of the Constitution of India for quashing the order dated 22.06.2016 (P=9) passed by Deputy Director, Health & Family Welfare, Punjab and order dated 14.06.2017 (P=12) passed by respondent no.1, whereby respondent no.4 has been declared senior to the petitioner, without issuing any notice or opportunity of personal hearing before passing the above mentioned orders inspite of the fact that since 07.08.2013, petitioner was shown to be senior in the seniority list uploaded and displayed on the website of the department of Medical Education & Research.

Para No.3 of the affidavit of respondent No.3 reveals that impugned order dated 14.06.2017, whereby respondent No.4 was declared senior to the petitioner has been withdrawn on 30.05.2019 (R=1).

In view of the above stand taken by respondent No.3, learned counsel for the petitioner, on instructions, has stated that present petition is rendered infructuous and the same be disposed off as such.
