JASWANT SINGH, J (ORAL) The petitioner, belonging to General Category, possesses the degree of Graduation with Punjabi as compulsory subject, B.Ed. with Punjabi as teaching subject, MA in Punjabi and has cleared the N.E.T Examination in Punjabi conducted by the U.G.C. She was selected and placed at Merit No.604 for appointment as Punjabi Mistress against 500 posts meant for General Category.
Her grievance is that at the time of counselling held on 28.9.2016, her candidature has been rejected on the ground that she does not possess Punjabi as an Elective Subject in her Graduation. It is claimed that the issue is no longer res integra as a Division Bench of this Court vide judgment dated 31.7.2007 (P.8)
CWP No.22340 of 2016 #2# has already decided the issue and held that such like candidates have to be treated as eligible, keeping in view the requirement of the Statutory Rules.
This Court, on 27.10.2016, while issuing notice of motion directed that one post of the Punjabi Mistress in general category be kept reserved for the petitioner. Upon notice, a reply has been filed.
At the time of hearing today, Mrs. Kulwinder Kaur, Assistant Director, Department of Schools, Punjab is present in Court and submits that the petitioner has now been considered eligible for appointment and her case for appointment and posting has been sent to the Competent Authority.
In view of the aforesaid circumstances, the present writ petition is disposed of as infructuous. The respondents are directed to issue an appointment letter without any further delay. The petitioner would be entitled to seniority, as per her inter se merit in this batch of selection.
