In the present petition, the challenge is to the impugned order dated 02.09.2020 (Annexure P-10) by which, the petitioner was sought to be compulsorily retired from service.

While issuing notice of motion, the Co-ordinate Bench of this Court had stayed the operation of the impugned order dated 02.09.2020 (Annexure P-10) due to which, the petitioner had continued working till the date he attained the age of superannuation i.e. 30.04.2023. 3.
Learned counsel for the petitioner submits that the benefits of pensionary benefits as well as the salary for the period, the petitioner worked with the respondents-department under the Court orders have not been released to the petitioner by the respondents, which action on the part of the respondents is totally arbitrary and illegal. 4.
At this stage, learned counsel for the respondents submits that in case, any of the salary for the period the petitioner had worked with the respondents-department under the Court orders has not been released in favour of the petitioner, the same will be released to him within the period of eight weeks from the date of receipt of certified copy of this order. With regard to the pensionary benefits, learned counsel for the respondents further submits that if the same have not been released to the petitioner then the same will be released to him within the stipulated period of eight weeks from the receipt of certified copy of this order. 6..
Learned counsel for the petitioner submits that keeping in view the statement made by learned counsel for the respondents herein above, the present petition may kindly be disposed of having been not pressed any further.
