(Oral) The instant Writ Petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Certiorari for setting aside impugned order dated 13.05.2025, passed by the Sub Divisional Magistrate, Tohana, District Fatehabad (Annexure P-5) under Section 152 of the Bhartiya Nagarik Suraksha Sanhita, 2023. 2.
Learned counsel for the petitioners submits that as against order dated 13.05.2025 (Annexure P-5), passed by the Sub Divisional Magistrate, Tohana, District Fatehabad, the petitioners had already submitted their objections dated 16.05.2025 (Annexure P-6), however, without passing any order under Section 157 of the Bhartiya Nagarik Suraksha Sanhita, 2023, the authorities are bent upon to dislocate the Hadda Rori in question. 3.
Pursuant to the advance copy of petition, having been supplied to the State, Mr. Rajneesh Chadwal, AAG, Haryana, appears on behalf of the respondent-State. CWP-15703-2025 (O&M) -2Divisional Magistrate, Tohana, submits that any final decision/order under Section 157 of the Bhartiya Nagarik Suraksha Sanhita, 2023 would be rendered after considering the objections submitted by the petitioners and affording due opportunity of hearing to all the stakeholders and till that time, no coercive action shall be taken against the petitioners. 4.
Keeping in view the aforesaid stand taken by learned State counsel, the instant writ petition stands disposed of, accordingly. 5.
