Through instant petition, preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ especially in the nature of Mandamus directing the respondents to grant the benefits of leave encahment as granted to their counterparts working in Govt. Schools, in view of instructions issued by government from time to time as well as in view of judgment passed by this Court in CWP No. 917 of 1998, titled as Raksha Rani Khosla v. State of Punjab and ors decided on 30.08.2013 (P-6) and CWP No.24890 of 2013, Parveen Kumar and ors. v. State of Punjab and ors, decided on 11.03.2016 (P-7).

At the very outset of the arguments, learned counsel for the petitioners submits that though petitioners moved representation dated 09.04.2018 (P-8) followed by legal notice dated 28.04.2018 (P-9) but till date Sonika 2018.07.27 16:43 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.17095 OF 2018 --2-- no conscious decision has been taken. He further submits that petitioners feel satisfied in case direction is issued to respondent No.4 to decide legal notice (P-9), within a stipulated period.

Instant petition is disposed of with a direction to respondent No.4Manager/President, S.D. High School, Sultanpur Lodhi, District Kapurthala to consider the claim of the petitioners and take a final decision on legal notice dated 28.04.2018 (P-9), within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioners still feel aggrieved against any of the order(s) passed by the concerned authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
