Sikander Singh & ORS v. State Of Punjab & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
Civil Writ Petition No.23364 of 2015 Date of decision: 02.11.2015 Sikander Singh and others
...Petitioners
Versus
State of Punjab and another
...Respondents
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA Present: Ms. Riti Aggarwal, Advocate for the petitioners. **** G.S.SANDHAWALIA, J, (Oral) The prayer made in the present writ petition is for seeking a direction to protect the pay of the petitioners as on 1.1.1996 alongwith all consequential benefits.
The relief claimed is on the basis as has been granted to other Junior Assistants in terms of decision of this Court in Civil Writ Petition No.22422 of 2010 titled Anil Kumar and another Vs. State of Punjab and others decided on 16.5.2012 (Annexure P/3). Counsel submits that she would be satisfied if legal notice dated 5.2.2015 (Annexure P/6) which has been served upon the respondents is decided within a specified period. Keeping in view the limited relief sought for, the present petition is disposed off without calling the respondents to file their reply. Accordingly, without commenting upon the merits of the case, the present writ petition is disposed of with a direction to respondent no.2 to decide the legal notice dated 5.2.2015 (Annexure P/6) expeditiously preferably within a period of three months from the date of receipt of a certified copy of this order. Needless to say that in case the relief is to be denied to the petitioner then reasoned order be passed by the said respondent.
The writ petition stands disposed of accordingly. November 02, 2015 (G.S.SANDHAWALIA) Pka Judge PRADEEP KUMAR ARORA 2015.11.03 09:17 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh
