*** ROHIT KAPOOR, J. (ORAL) Learned counsel for the petitioner inter alia contends that the learned District Judge, Rohtak while dismissing the application filed under Order 39 Rules 1 & 2 of the Code of Civil Procedure vide Order dated 14.05.2025 has wrongly recorded that the counsel for the petitioner/plaintiff was not ready to argue the main appeal. I have heard learned counsel for the parties. Learned counsels are ad idem that they have no objection, if the Order dated 14.05.2025 is set aside with a direction to the learned District Judge, Rohtak, to decide the appeal in a time bound manner. Without going into the merits of the case, the Order dated 14.05.2025 passed by the learned District Judge, Rohtak, is hereby set aside with a direction to the learned District Judge, Rohtak to decide the appeal on or before the date already fixed.
Disposed of in the aforesaid terms.
