This is a petition under Section 482 of Cr.P.C. for directing respondent no.2 to take action against respondent nos.3 to 7 on the basis of complaint dated 21.10.2020 (P-4).

Contends that despite issuance of notice in civil suit (P-2), respondent nos.4 to 7 are not appearing before the Court below; rather bent upon to harass the petitioners in connivance with police. Also contends that as a matter of fact, both petitioners are innocent as they have not committed any offence, yet pressurized by respondent no.3 at the instance of private respondents to settle the dispute. Heard learned counsel for petitioners and perused the paper-book.

Undisputedly, suit for permanent injunction has been filed by both the petitioners along with one Jasbir Singh against private respondents before the Court of Ld. Civil Judge at Batala and the same is pending as on today. If the private respondents are not appearing before the Court below or pressurizing the petitioners to settle the issue

 

 with the intervention of police official i.e. respondent no.3, then it would be appropriate for them to take recourse to the remedy where Civil Suit is going on; but certainly, the present petition is not the right course. In view of above, this Court has no option except to dismiss the petition.

Ordered accordingly.

However, petitioners would be at liberty to raise their grievance(s) before the learned Court where civil suit is pending and this order be not construed as a bar for that purpose. %
