This petition has been filed under Section 482 Cr.P.C. r/w 528 BNSS for quashing the impugned order dated 05.11.2024 (Annexure P-3) passed by Ld. Judicial Magistrate Ist Class, Gurdaspur whereby petitioner has been declared as Proclaimed offender/person in FIR No.42 Dated 10.08.2022 u/s 452, 448, 323, 506, 148, 149 IPC (Corresponding section 331(5), 329(4), 115(2), 351, 191(3), 190 BNS 2023), PS Behrampur, District Gurdaspur (Annexure P-1).

Learned counsel for the petitioner submits that due to nonservice, the petitioner could not appear before the learned trial Court on the date fixed. Consequently, he was declared as Proclaimed offender/person vide order dated 05.11.2024. Learned counsel for the petitioner further submits that the petitioner is ready and willing to join the proceedings before the Court and prays that the impugned order be set aside. 3.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file. 6.
In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 05.11.2024 passed by Ld. Judicial Magistrate Ist Class, Gurdaspur. However, in case the petitioner surrenders before the trial Court within next 07 working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court concerned within a period of three days.

The petition stands disposed of.
